Waiting on a refund for disgusting apartment
I lived a total of 10 days in apt 2, carpet was nasty, dirty qtips and socks on floor, toothpicks, furniture was falling apart. Not at all like photos suggested. When called about concerns, got told I was lying. Business address is vacant so cannot sue him in small claims. Does not live in SD and has rented apartment to someone else and I have not received my refund and am owed almost $3,000. He will not respond to my texts. Pursuing this with state representative help as I am a traveling professional from out of state.
As promised from the beginning we would work with you in a professional manner in conjunction with the terms of the lease agreement and our stated cancellation policies. We have documentation of all of our property turns for both move in and move out. We have bent over backwards to help you during your lease term and sent over multiple staff to address your concerns and questions which were all resolved or scheduled to be resolved within a few hours of your arrival. We had nothing but good comments from the guests before and after your stay with multiple guests requesting extended stays beyond the intial term.
We offered you alternative housing and lodging during your stay and transistion which you declined. We worked to get new tenants to cover your lease responsibilities on your lease from 10/19/24 - 2/24/25. We issued you credits for those stays by new tenants after they were completed. You have threatened to slander us with every agency in the rental community simply for asking you to honor your commitments with your signed lease agreement and cancellation policy. We have extensively communicated with you via multiple platforms over the past few months. You have continually threatened to defame and slander our business and me personally with your bank, your employer, your staffing agency, small claims, and city of Sioux Falls. We have always treated you in a professional manner from the beginning of our business relationship.
As promised from the very beginning we have issued rent credits and payments for prorated amounts that we were able to find alternate renters to cover your responsibilities in accordance with the signed lease aggreement and cancelation policy. Your signed lease agreement was just completed on 2/24. We were delayed in processing your rebates because you had reversed charges on your credit card and then continued to ask for the same amounts to be sent to you as a refund. Once that was resolved the promised prorated refunds were issued in accordance with the signed lease agreement and our cancelation policies as promised months earlier.
