Lost deposit after mouse problem

This apartment had a mouse problem a short time after my move in date, which made it uninhabitable. Upon further inspection, there were drippings around the house and holes for mice to come into. For a small studio apartment that is a short term rental, this was a hazard. As the issue was dragging on, inhibiting me from staying in the apartment, I had to leave, and my security deposit was not refunded even though it was due to the condition of the apartment (my security deposit was more than the rent payed to date). When I asked for it, they indicated that they would not be able to refund the deposit as the apartment was reserved for me, which implies they were willing to rent it out in that condition. In addition, the dishwasher did not work.
